I was only two weeks ago I reported of the homophobic band of doctors “Doctors For The Family” in my report “Doctors In The Dark” with their submission that included Victoria’s Deputy Chief Of Psychiatry Dr Kuruvilla George against changes to allow equity to gay and lesbian people.
Sadly I know that homophobia is well and truly present in medicine, but when homophobic attitudes puts the life of a patient at risk my blood boils.

New Jersey gay man Joao Simoes is suing his hospital after an on-staff doctor refused him his HIV medications. Dr. Susan Borja allegedly later told his private physician what the patient had done to become infected was “against God’s will.”

A gay HIV-positive man says in court that a hospital denied him treatment and visitors, as the doctor remarked, “This is what he gets for going against God’s will.” Joao Simoes sued Trinitas Regional Medical Center in Union County Superior Court. He says that the hospital admitted him in August 2011, but that “requests for his lifesaving medication were not honored,” and his sister was denied visitation rights.
Susan V. Borja, M.D., from the Department of Behavioral Health and Psychiatry, allegedly approached Simoes while he was confined to the hospital’s mental health wing. Borja is not named as a defendant.
To be honest I am unsure why Dr Borja has not been named a defendant having read the following…
[Dr Borja's] reaction was allegedly different when Simoes said that he did not work because he planned to go back to school and because of his HIV status. Borga then allegedly asked Simoes how he got HIV, to which he responded, “I got it from unprotected sex.”
The complaint then says that “Dr. Borga closed the plaintiff’s file, put it down and looked at plaintiff with disgust on her face and asked, coldly, “Is that from sex with men?”
Simoes says he responded affirmatively and that, “immediately after hearing this, Dr. Borga proceeded to exit the room.”
After this consultation, no nurse or doctor came to see Simoes, even though he told them that he needed to take his HIV medication, according to the complaint.
When the hospital finally permitted Simoes to call his personal physician on the third day of his stay, he learned that the doctor had already spoken with Borga about Simoes’ medication, according to the complaint. Borga allegedly responded: “You must be gay, too, if you’re his doctor.” “Additionally, apparently realizing that plaintiff’s doctor had an accent, Dr. Borga exclaimed, ‘What, do you need a translator?’ to which plaintiff’s doctor had again responded that Dr. Borga needed to give plaintiff his HIV medication,” the complaint states. “Dr. Borga responded to plaintiff’s doctor by stating, ‘This is what he gets for going against God’s will,’ and hung up the phone on plaintiff’s doctor.”
A search of the NJ medical register was able to show that Dr Borja continues as a psychiatrist working at Trinitas Medical Centre.
I urge all people who live in the USA, in particular New Jersey to consider lodging a complaint to the NJ State Board Of Medical Examiners or by contacting their office via the State Board Of Medical Examiners here.
On a final note, if you are HIV positive and a doctor who is not your HIV doctor changes or stops your medications ask them why. If they do not give an answer that is satisfactory to yourself demand they contact your HIV doctor or the infectious disease specialist of the hospital. If that fails, ask to speak with management immediately. Any delay in treatment can lead to decline in health and development of resistance of treatment regimes.
I hope that this has been an isolated case and that this doctor is educated that her actions were homophobic, dangerous and morally wrong. If this is not able to be done I hope that the medical board may see fit to review her ongoing work as a doctor.

What a funny story……….we don’t have that here in the Netherlands

Agree calling her office is probably going to do no good. I hope that someone state side is able to ensure that the medical board is reviewing the situation and perhaps even the hospital.
I was considering writing to the hospital however as they are the plaintiff I doubt there is any point in communicating with them.
What does need to happen, as has happened here in Australia is that it has to become abundantly clear that being a faggot does not make you a 2nd class citizen and diminish rights as a patient.
Given that it appears this has not been thrown out of court is an indicator to myself that there is merit to the charges.
Not clear exactly what stage of proceedings they’re at, but throwing things out early on usually happens if the claim is completely nonsensical rather than where facts are disputed. If one party says something happened at the other says it didn’t happen like that, the court needs to hear the claims and make a judgement on what happened. If it’s a secular hospital it can’t do any harm writing to them – they might be defending the lawsuit but at the same time quietly considering whether they can sack the doctor, for example. As for retraining – George, you and I are members of two of the more arrogant, attitude laden professions out there (present company excepted, of course). Psychiatrists are said to be even more so (the difference between God and a psychiatrist? remember that one?). The board or hospital need to be down on her like a tonne of bricks and she needs supervised practice or striking off.
I’d also be interested in other staff that were working there. As an RN, part of my responsibility is to look for oversight. If I knew a patient was HIV+ and not receiving medications (which the nursing staff administer), that would raise a red flag. I’d be inquiring as to why. I’d be asking the treating physician why. There would have to be a pretty damn good reason coming from an infectious disease doctor. I wouldn’t of accepted a psychiatrist’s order as good enough rationale. This type of behaviour has no place in medicine.
George -the complaint process in the USA is quite lengthy. Formal complaints to the medical board are pretty much limited to a patient or another licensed individual. Speaking from experience, the results of an “investigation” are often times disappointing. The best way to have this matter addressed is by doing exactly what you’re doing -raising awareness about the situation. Public outcry will get the ball rolling much faster than via the licensing board.

Just a caution on Scott’s note above. We’ve got this story via a couple of blogs – none 0f us were there. There might be more to it than we realise. If the story is true (and without any special context) then Dr Borja really should be struck off or otherwise disciplined by the proper authorities. Lets not turn it into too much of a witch-burning exercise, though, eh?
Vaughan, I agree it’s important that we don’t make this a witch hunt however it’s important to note that all of the details are a matter of public record from the court notes.
They’re what is claimed by one of her patients, who is suing her employer and who seems to have psych issues. I’m not for a moment saying it didn’t happen precisely as he describes, but we can’t know that for certain because none of us were there. I’d question whether encouraging people to ring up Dr Borja’s clinic to let her know their sentiments is the best option.
Also can’t for the life of me understand why the good doctor isn’t being named a defendant and sued for malpractice…maybe they plan on going after her once the hospital is taken care of!
